Counties RC 3 May 2019 - R 10 (request for a ruling) - Chair, Mr N McCutcheon

Created on 09 May 2019

Rules:
632(1)
Committee:
NMcCutcheon (chair)
Stipendiary Steward(s):
Mr A Coles - Stipendiary Steward
Name(s):
Ms R Smyth - Rider of PATSYS LASS, Mr E Green - Trainer of PATSYS LASS, Mr T Harrison - Starter, Mr W Robinson - Stipendiary Steward
Information Number:
A11272
Evidence:

Following the running of Race 10 (Patumahoe Plumbing 1600) Information No. A11272 was filed with the Judicial Committee. It was a Request for a Ruling as to whether PATSYS LASS was denied a fair start pursuant to Rule 632(1) of the NZ Rules of Racing.

Submission For Decision:

Mr Coles showed the film replays of the start of the race. He said that prior to the start being effected PATSYS LASS who drew barrier 1 reared up and it appeared that the Rider Ms Smyth had lost the use of her near-side stirrup iron. He said that the start was then made and shortly after leaving the barrier Ms Smyth was dislodged from her mount.

Ms Smyth confirmed that she did lose her iron when her mount reared and was still trying to retain same when the start was effected and as a consequence she was unbalanced and fell from her mount. She said that prior to the start being effected she had called out to the Starter that she was not ready.

The Starter Mr Harrison was asked by the Chair if he had had any observation of the incident in question. He responded by saying that Ms Smyth did call out and that he thought she had said that she was ready. He said that after seeing the films it was obvious that she was not.

Stipendiary Steward Mr Robinson was present at the start and standing very close to stall no. 1.

He said that he heard Ms Smyth say very clearly that she did not have her foot in the iron. He said that the start was then made and he observed that Ms Smyth did not have her left foot in the iron and that as her horse left its barrier stall Ms Smyth made contact with the side of the stall and fell from her mount.

Reasons For Decision:

After considering all of the submissions and in particular those of Ms Smyth and Mr Robinson whose evidence was supported by the films, the Committee was comfortably satisfied that PATSYS LASS had been denied a fair start due to its Rider not having a foot in the iron when the start was effected.

Decision(s):

PATSYS LASS was declared a non-runner under the provisions of Rule 632(1) with all investments on that horse to be refunded.
