Created on 22 November 2020
Committee:
GHall (chair)Respondent(s):
Mr L Bond - Trainer of THE PEAKY BLINDERInformant:
Ms R Haley - Stipendiary StewardInformation Number:
A12885Horse Name:
THE PEAKY BLINDERPersons present:
Mr N Ydgren - Chief Stipendiary StewardEvidence:
Miss Haley sought the disqualification of horse 3, THE PEAKY BLINDER, placed 5th after a successful protest as it galloped in excess of 150 metres in the early stages of the race.
Placings after an earlier successful protest were:
1st – 12 RYDGEMONT MILLY
2nd - 9 TWEEDLEDEE
3rd – 6 HORSE OF COURSE
4th – 5 ALPINE RETREAT
5th – 3 THE PEAKY BLINDER
Submissions For Decision:
Mr Ydgren demonstrated on the videos that THE PEAKY BLINDER galloped for over 150 metres in the early stages of the race.
Mr C Ferguson, the driver of THE PEAKY BLINDER, did not contest the protest.
Reasons For Decision:
After viewing the videos from the various angles, the Committee is satisfied that THE PEAKY BLINDER was not in its proper gait for a distance in excess of 150 metres. THE PEAKY BLINDER was free of interference at the time. The breaking horse regulations are clear in that the horse is deemed to be in breach of r 870(3) in that it has failed to promptly regain its proper gait.
Decision:
As THE PEAKY BLINDER has gained an advantage over the field, it is appropriate that the horse be disqualified.
Amended placings are:
1st – 12 RYDGEMONT MILLY
2nd - 9 TWEEDLEDEE
3rd – 6 HORSE OF COURSE
4th – 5 ALPINE RETREAT
5th – 7 AMABEDE
Stakes and dividends are to be paid accordingly.
