Evidence:

Miss Haley sought the disqualification of horse 10, ONLY ONE WAY, placed 5th by the judge as it galloped in excess of 150 metres in the back straight on the final occasion.

Judges placings were:
1st - 12 RYDGEMONT MILLY
2nd - 9 TWEEDLEDEE
3rd - 6 HORSE OF COURSE
4th - 5 ALPINE RETREAT
5th - 10 ONLY ONE WAY

Submissions For Decision:

Mr Ydgren demonstrated on the videos that ONLY ONE WAY galloped for approximately 180 metres in the back straight.

Mr Williamson did not contest the protest.

Reasons For Decision:

After viewing the videos from the various angles, the Committee is satisfied that ONLY ONE WAY was not in its proper gait for a distance in excess of 150 metres. ONLY ONE WAY was free of interference at the time. The breaking horse regulations are clear in that the horse is deemed to be in breach of r 870(3) in that it has failed to promptly regain its proper gait.

Decision:

As ONLY ONE WAY has gained an advantage over the field, it is appropriate that the horse be disqualified.

2nd - 9 TWEEDLEDEE
3rd - 6 HORSE OF COURSE
4th - 5 ALPINE RETREAT
