Created on 18 January 2021

Rules:
638(1)(d)
Committee:
NMcCutcheon (chair)
NMoffatt
Name(s):
Mr D Bradley - Rider of HUNTA PENCE
Mr N Goodwin - Stipendiary Steward
Informant
Mr J Oatham - Chief Stipendiary Steward
Information Number
A14120
Plea:
Admitted
Charge:
Careless Riding
Evidence:

Following the running of Race 7 (Dixon & Dunlop Trentham Stakes Group 3) Information A14120 was filed with the Judicial Committee. It was alleged by the Informant that Mr Bradley the Rider of HUNTA PENCE allowed his mount to shift in near the 500m when not clear of FISCAL FANTASY which was checked.

Mr Bradley advised the Committee that he understood the Rule and the charge and confirmed that he admitted the breach of the Rule.

Mr Goodwin showed the film replays and identified the horses involved. He said that approaching the 500m Mr Bradley was racing one-off the fence, shortly after Mr Innes attempted to improve up inside Mr Bradley’s mount but that Mr Bradley went over to the fence. Mr Goodwin said that when Mr Bradley shifted in he was not clear of Mr Innes and he had to check at a vital time.

Mr Bradley for his part said that he had been racing adjacent to the fence throughout the race. He said that he came off the fence at the 600m looking for a run, but went back to obtain a run to the inside. He added that Mr Innes was held up and not checked. He said that when he shifted he was unaware that Mr Innes was to his inside.

Decision:

As the charge was admitted it was deemed proved.

Submission For Penalty:

Mr Oatham produced Mr Bradley’s record that showed two prior breaches during the past 12 months: 5 September 2020 - 6 days suspension and 9 January 2021- 6 days suspension and a fine of $600. The Stewards placed the carelessness in the low to mid-range category.

Mr Bradley said that it was human error on his part.

Reasons For Penalty:

The Committee placed the carelessness in the low-range category only and adopted a starting point of 4 days suspension and a fine of $250. With respect to the Group 3 status of the Race, acting under the provisions of Rule 920(2) we uplifted the term of suspension by one day and increased the fine to $500. We did not apply any credit for the record.

Penalty:

Mr Bradley’s Jockey’s Licence was suspended from 30 January through to 10 February 2021 inclusive (5 Riding Days) and fined $500.

(Mr Bradley was already due to commence a term of suspension at the conclusion of today's racing up to 30 January 2021).
