Evidence:

Following the running of Race 1 (Gee & Hickton Funeral Directors Premier) Information No. A11673 was filed with the Judicial Committee. It was alleged that Mr Dee used his whip excessively prior to the 100m on his mount CREATIVE GENIUS. The horse finished in third position.

Mr Dee said that he understood the Rule, Charge and confirmed that he admitted the breach.

Mr Goodwin showed the film replays and said that Mr Dee had hit his horse 8 times between the top of the straight and the 100m.

Mr Dee agreed with the Stipendiary Steward’s assessment of his whip use.

Decision:

As the Charge was admitted it was deemed proved.

Submission For Penalty:

Mr Oatham said that Mr Dee had a good record in Australia and invited the Committee to impose a penalty in line with the JCA Penalty Guide.

Mr Dee confirmed that his record in the last 12 months was clear of any whip breach.

Reasons For Penalty:

The Committee was satisfied that Mr Dee had hit his horse 8 times prior to the 100m. The JCA Penalty Guideline starting point identifies a fine of $300 for a first breach and as there were not any mitigating or aggravating factors to consider the starting point penalty was deemed to be an appropriate penalty.

Penalty:

Mr Dee was fined $300.
