Careless RidingEvidence:
Following the running of Race 1, the Donaghys Maiden, an Information was filed by Stipendiary Steward, Mr Goodwin, against Mr Tanaka, alleging careless riding in that he allowed his mount, MR MURFITT, to shift in near the 75 metres when not sufficiently clear of TWO EYE, ridden by Mr S McKay.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Tanaka acknowledged that he understood the Rule and confirmed his admission of the breach.
Mr Goodwin demonstrated on the race films that as the field entered the final 100 metres of the race MR MURFITT was wide on the track with TWO EYE to its inside MR MURFITT, under hard riding, shifted inwards as he came alongside TWO EYE resulting in Mr S McKay having to check his mount quite sharply.
Mr Goodwin submitted that Mr Tanaka “took far too long” to straighten his mount and Mr McKay was forced to take a substantial hold of his mount.
Mr Tanaka agreed with the Stewards’ assessment and did not want to make a submission.
Decision:
As Mr Tanaka admitted the breach, the Committee deemed the charge proved.
Submission For Penalty:
Mr Goodwin said that in the view of the Stewards the interference was in the mid-range of seriousness. He said Mr Tanaka is a busy senior rider who gets a lot of rides.
The Committee noted Mr Tanaka incurred two suspensions earlier this year, the most recent a 10 national days stand-down when guilty of low to mid-range careless riding in the New Zealand Derby at Ellerslie, a Group One race on March 3rd.
Mr Tanaka made no comment in regard to penalty other than to advise that he had confirmed rides at the Hawke’s Bay meeting on Saturday, June 30 2018 and any suspension could start following that meeting.
Reasons For Penalty:
In viewing the available films of the incident it was clear that Mr Tanaka had allowed his mount to shift in between two and three horse widths over approximately five strides when not the required distance clear of TWO EYE before straightening his mount, his actions coming too late to avoid interference.
The Committee believe a period of suspension is an appropriate penalty.
The Committee assess the degree of carelessness to be in the mid-range for which the starting point in the JCA penalty guide is an eight suspension. We have applied a discount of one day for Mr Tanaka’s admittance of the breach. There are no aggravating factors.
Penalty:
Mr Tanaka is suspended from the close of racing on June 30th 2018, up to and including July 13th, 2018 - 7 National Days.
