Evidence:

Following the running of Race 6 (Duke Of Gloucester Cup) Information No.A11612 was filed with the Judicial Committee.  It was alleged by the Informant that Mr Harrison the Rider of LOOK OUT used his whip excessively prior to the 100m.

Mr Balcombe showed the film replays and said that Mr Harrison struck his mount 11 times with the whip prior to the 100m with only the odd respite being given.

Mr Harrison agreed with the Stipendiary Steward’s assessment of his whip use.

Decision:

 As the breach was admitted by Mr Harrison it was deemed proved by the Committee.

Submission For Penalty:

Mr Balcombe said that Mr Harrison had a clear record.  He placed the breach in the mid-range and submitted that a fine would be a suitable penalty.  

Reasons For Penalty:

The JCA starting point for a first breach of the Rule is a fine of $300.  Taking into account all matters in relation to the breach of the Rule the Committee determined that the guideline starting point was the appropriate penalty.

Penalty:

Mr Harrison was fined $300.
