Following the running of Race 4 (B Connors Family Clan 1600), Information A14136 was filed with the Judicial Committee. It was alleged by the Informant that Ms Hirini had allowed her mount to shift out near the 300m when not clear of LUCKY VIKING (K Hercock) which was checked.
Ms Hirini said that she understood the Rule, Charge and confirmed that she admitted the breach.
Mr Goodwin showed the film replays, identified the two horses and said that Ms Hirini shifted out when not clear and that Ms Hercock had to check her mount. He said that when Ms Hirini first shifted there may have been room to do so but that Ms Hercock had improved quickly and that Ms Hirini continued on an outward movement when not clear. He added that Ms Hirini had looked twice to her outside.
Ms Hirini said that she thought that she had enough room, but that there was not. She said that it was too late when she became aware that there was a horse on her outside.
Decision:
As the charge was admitted it was deemed proved.
Submission For Penalty:
Mr Williamson said that Ms Hirini’s record over the last 12 months was clear. He said that the check to LUCKY VIKING was a reasonable one, but that there were mitigating factors to consider:
• She looked twice
• Ms Hercock and her mount improved quickly
• Ms Hirini’s mount was stopping
• A good record
Ms Hirini said that any suspension could start after 25 June.
Reasons For Penalty:
The Committee took into account all submissions plus the JCA Penalty Guidelines when fixing an appropriate sanction.
Ms Hercock’s mount did receive a relatively severe check but there were mitigating features which placed the carelessness in the low to mid-range category. It was determined that a 4-riding day suspension and a $200 fine be imposed.
Penalty:
Ms D Hirini’s Jockey Licence was suspended from the close of racing on 25 June through to the cessation of racing on 2 July 2021 and a $200 fine imposed.
