Excessive use of the WhipEvidence:
Following the running of Race 3 (Cotter & Stevens Mdn), Information A14116 was filed with the Judicial Committee. It was alleged that Ms Hercock used her whip excessively in the home straight (prior to 100m).
Ms Hercock confirmed that she admitted the breach and understood the Rule.
Mr Goodwin showed the film replays and said that Ms Hercock used the whip 9 times on her mount prior to the 100m.
Ms Hercock agreed with Mr Goodwin’s evidence.
Decision:
As the charge was admitted it was deemed proved.
Submission For Penalty:
Mr Goodwin said that Ms Hercock has only been back race riding for a short term and that this was her first charge.
Ms Hercock for her part said that she admitted the breach and had a rush of blood, as she was in front and had a chance to win. She added that since being back riding this was the first time she had been on a winning chance.
Reasons For Penalty:
The film evidence was very clear that Ms Hercock had used her whip excessively.
The Committee took into account that it was Ms Hercock’s first breach of the Rule, the admitted charge and the JCA penalty starting point of a $300 fine for a first offence.
Considering all of those matters it was determined that a fine of $350 was a suitable penalty.
Penalty:
Ms Hercock was fined $350.
