Waimate TC 28 March 2021 - R 9 - Chair, Mr P Knowles

Created on 31 March 2021

Rules:
869(3)(b)
Committee:
PKnowles (chair)
Name(s):
Mr S McNally - Open Driver
Mr V Munro - Stipendiary Steward
Informant
Ms R Haley - Stipendiary Steward
Information Number
A13952
Plea:
Admitted
Charge:
Careless driving
Evidence:

Mr McNally was charge with a breach of r869 (3) (b) – careless driving - following an incident in Race 9. Stewards alleged that “Mr McNally (PUNT AWAY) drove carelessly into the first bend when shifting inwards and checking MARTIN JOHN”

Mr McNally admitted the charge and appeared at the hearing.

Mr Munro, with the use of the videos, stated Mr McNally crossed over in front of MARTIN JOHN when entering the first bend. He was not fully clear of MARTIN JOHN and his sulky wheel struck the front leg of MARTIN JOHN causing that horse to break and lose its position.

Mr McNally stated he allowed PUNT AWAY to drift inwards. He thought he was clear. It was an error of judgement on his part.

Decision:

Mr McNally admitted the charge and it is found proved.

Submission For Penalty:

Ms Haley said Mr McNally had had 5433 lifetime drives and 118 drives this season. His record was very good and he had admitted the breach. She sought a suspension of 3 days.

Mr McNally did not seek a deferment and submitted a 2 day suspension rather than 3 days. He had admitted the charge and had a good record.

Reasons For Penalty:

After considering submissions the Committee took into account Mr McNally’s excellent record and early admission of the charge and gave him credit. A suspension at the lower end of the scale is appropriate.

Penalty:

Mr McNally is suspended from the completion or racing today up to and including 1 April 2021 (2 days).
