Mr Davidson alleged that Mr Khetto in Race 8 made a celebratory gesture prior to the finishing line.
Mr Davidson demonstrated on the videos that the Respondent some three strides before the winning post stood up high in his irons and made a celebratory gesture. Mr Khetto explained it was his first winner and he had had a brain explosion as he was so happy.
Decision:
As Mr Khetto has admitted the breach it is found to be proved.
Submission For Penalty:
Mr Davidson said recent previous breaches of this Rule had resulted in fines of between $200 and $250. He emphasised the extravagant nature of the gesture.
Mr Walsh stated that the Respondent had had a period of time without work and had then had visa issues. It had been a difficult time for Mr Khetto, but he now had a new employer and a visa. This was his first ride on a horse that had a real chance of winning the race. And in his excitement, Mr Khetto had got carried away with the occasion.
Reasons For Penalty:
The breach is high end. Mr Khetto is high in the saddle some three strides from the line. The possibility of his horse taking fright and him falling off is quite evident.
We take into account that the Respondent is a young inexperienced apprentice and that the breach occurred through his exuberance with this being his first winning ride.
Penalty:
We impose a fine of $250.
