Evidence:

Stewards charged Mr K Chowdhoory with excessive use of the whip following Race 7. The Stewards alleged Mr Chowdhoory was in breach of r638 (3) (b) (ii) prior to the 100 metres mark. Mr Chowdhoory appeared at the hearing assisted by Mr Pitman.

Ms Haley, with the use of the videos, pointed out the position of EASYRIDER as the field entered the home straight. Mr Davidson stated Mr Chowdhoory was challenging for the lead and was seen to use his whip eight times from the top of the straight to just prior to the 100 metres mark. They were not punishing strikes with the whip, but too many.

Mr Chowdhoory stated he was caught out by the long straight. He said he was in a position to win and got too excited. He had misjudged the distance and the number of strikes. Mr Pitman accepted the evidence as given.

Decision:

Mr Chowdhoory admitted the charge and it is found proved. 

Submission For Penalty:

Mr Davidson stated Mr Chowdhoory had an excellent record with no prior charges inside the last six months. He submitted the standard fine of $300 for a first offence under the Rule.

Mr Chowdhoory accepted the penalty submission of the Stewards.

Reasons For Penalty:

Mr Chowdhoory has an excellent record and admitted the charge at the outset. The standard fine submitted by the Stewards for a first offence is reasonable.

Penalty:

Mr Chowdhoory is fined $300.
