Excessive Use of the WhipEvidence:
The Stewards charged Mr Aukett with a breach of r 638(3)(b)(ii) in that he used his whip excessively prior to the final 100 metres.
Miss Haley demonstrated on the video that the Respondent struck his mount nine times before the final 100 metres of the race. Three of these strikes were in the straight
Mr Aukett said he had been told the horse could switch off in its races and this explained the first strike at the 500 metres. It was a misjudgement. He had not ridden on the course for a number of years.
Decision:
Mr Aukett admitted the charge and it is found proved.
Submission For Penalty:
Mr Davidson said the starting point in the JCA Penalty Guide is a fine of $500. He did not believe any uplift was required as there had only been 12 strikes during the course of the race
Mr Aukett reiterated he had made a misjudgement.
Reasons For Penalty:
Mr Aukett has a previous breach of this Rule in the past six months and has admitted the breach. The starting point in the JCA Penalty Guide is a $500 fine.
Penalty:
Mr Aukett is fined the sum of $500 and is reminded of his obligations under the Rules.
