Evidence:

The Stewards charged Mr Johnson with a breach of r 638(3)(b)(ii) in that he used his whip excessively prior to the final 100 metres.

Miss Haley demonstrated on the video that the Respondent struck his mount eight times before the final 100 metres of the race.

Mr Johnson said the horse was a touch lazy, but he recognised this was no excuse and he had simply made a misjudgement.

Decision:

Mr Johnson admitted the charge and it is found proved.

Submission For Penalty:

Mr Davidson said the starting point in the JCA Penalty Guide is a fine of $500.

Mr Johnson questioned whether there was a discount for an admission of the breach.

Reasons For Penalty:

Mr Johnson has a previous breach of this Rule in the past six months and has admitted the breach. The starting point in the JCA Penalty Guide is a $500 fine. There is no discount for the admission of the breach as the breach of this Rule is self-evident from the video.

Penalty:

Mr Johnson is fined the sum of $500 and is reminded of his obligations under the Rules.
