Excessive use of the WhipEvidence:
Following the running of Race 7, Farmlands Otautau and Andrew Tough Plumbing, an Information was lodged by Stipendiary Steward, Mr M Davidson against Jockey, Miss T Comignaghi, alleging that Miss Comignaghi as the Rider of SPIDER LILLY used her whip in an excessive manner prior to the 100 metres.
Rule 638 (3)(b)( ii) provides: - a rider shall not strike a horse in a manner, or to an extent which is excessive.
The NZTR Whip Guidelines that came into force on the 9 Dec 2020 provides that there is a limitation of 5 strikes with the whip prior to the 100 metres mark.
Miss Comignaghi was present and confirmed she understood the Rule and the Whip Guidelines, and she confirmed that she admitted the breach.
Stipendiary Steward, Mr M Davidson demonstrated the incident by the use of the race films. He identified Miss Comignaghi riding Spider Lilly and showed where she had used her whip 8 times prior to the 100 metre mark.
Miss Comignaghi agreed with the number of strikes.
Miss Comignaghi stated she had made an error of judgement, urging her mount on in the very heavy footing.
Decision:
The breach is admitted and therefore the charge is proved.
Submission For Penalty:
Mr Davidson said that Miss Comignaghi had an excellent record under this Rule, with this being her first breach.
He said that in terms of the Guidelines the prescribed penalty was a fine of $300.
Miss Comignaghi had no submissions on penalty.
Reasons For Penalty:
The films were very clear, and the number of strikes was agreed.
The Penalty Guidelines provide for a fine of $300 and there were no compelling reasons to deviate from this.
Penalty:
Miss Comignaghi is fined the sum of $300.
