Following the running of Race 6, PGG Wrightson and Steven Shearing Contracting, Information A11765 was lodged by Stipendiary Steward, Mr Davidson against Jockey, Miss T Jonker, alleging that Miss Jonker permitted her mount MASTER LINCOLN to shift inwards dictating TOP OF THE STRAIGHT (T Moseley) inwards onto MIRADELLO (S Wynne) which was checked by the 1300 metres.
Rule 638(1)(d) provides: - a rider shall not ride carelessly.
Miss Jonker was present and she confirmed she understood the Rule , and the new Careless Riding Guidelines and she also confirmed the admittance of the breach.
Mr McIntyre demonstrated on the films the inward movement of MASTER LINCOLN who was racing wider on the track near the 1300 metre mark. Mr McIntyre said that the inward movement had caused TOP OF THE STRAIGHT to move inwards onto MIRADELLO who as a result was checked.
Miss Jonker agreed with Mr McIntyre’s summation, stating that it was not a deliberate or intentional act to move inwards, and that she had made a simple error of judgment.
Decision:
Miss Jonker has admitted the charge and it is found proved.
Submission For Penalty:
Mr Davidson produced Miss Jonker’s record which showed one breach of this rule over the past 12 months. This was at the Central Otago Racing Club on 27 November 2020, where she received a 4 day suspension and a $250.00 fine.
Mr Davidson described the breach being at the low end of carelessness.
Miss Jonker sought deferment of her penalty until after the Kumara Races on January 9, where she confirmed she had several rides including THE BUFFER (Trainer, K Rae), in one of the major races of the day.
Miss Jonker when questioned stated she was riding up to 3 or 4 horses per race day.
Clarification was sought from the Stipendiary Stewards around Miss Jonker’s request, which Rules 1106(2)(b) or Rule 1106(3)(b) were deemed as relevant to the request.
The Deferment Rule reads: If, at the time suspension is imposed, the Rider is engaged to ride a horse in a race(s) during the next 7-day period after the day on which the suspension is imposed, then the suspension will be effective as set out in Rule 1106(2)(B), however if the Rider is engaged to ride a horse in a race during the 8th, 9th or 10 th day after the day on which the suspension is imposed the suspension will be effective from the earlier of:
3.1. the completion of such engagements within that period; or 3.2. From the day immediately following the 10th day the suspension was imposed.
Reasons For Penalty:
Miss Jonker has allowed her mount MASTER LINCOLN to move inwards when not sufficiently clear, pushing TOPD OF THE STRAIGHT inwards, who in turn has moved inwards onto MIRADELLO checking this horse.
The NZTR revised penalty guidelines for careless riding provide a starting point of a $250 fine and a 4 day suspension for a low end breach.
The Committee accepts Mr Davidson's description of the breach at low end.
The Committee takes a starting point of 4 day suspension and $250 fine.
The aggravating factor is that it is a second offence within the past 6 weeks, lifting the suspension by 1 day to 5 days.
A mitigating factor was the forthright early guilty plea reducing penalty by 1 day.
Penalty:
Miss Jonker is suspended from the end of racing on Saturday 9 January 2021 up to including Saturday 16 January 2021. It is also noted that the Otago Racing Club Meeting on the 16th January 2021 is a Feature Day meeting.
This is four days and Miss Jonker is fined the sum of $250.
