Evidence:

Following the running of Race 6 (Opal Kiwi Packaging Kiwifruit Cup 2100m) Information No. A12932 was filed with the Judicial Committee. It was alleged by the Informant that Mr Kareem had used his whip excessively on MY GIFT prior to the 100m.

Mr Kareem in the presence of Mr Harris said that he understood the Rule, the Charge and confirmed that he admitted the breach.

Ms Algar showed the film replays and pointed out where Mr Kareem had struck his mount 8 times prior to the 100m (5 being the limit).

Mr Kareem and Mr Harris agreed that the number of strikes was 8.

Decision:

As the charge was admitted it was found proved by the Chair.

Submission For Penalty:

Mr Jones said that Mr Kareem had one prior breach of the Rule within the last 12 months, that being on 21 December 2019, on that occasion he was fined $500.

He added that the reason there had been an uplift from the starting point of $300 was due to Mr Kareem using his whip arm above the shoulder.

Mr Harris said that it was a big race and that Mr Kareem had got a little carried away. He added that the strikes were not aggressive.

Mr Kareem said that he was in with a chance of winning and that he got excited.

Reasons For Penalty:

The JCA Penalty Guide starting point for a second breach within 12 months is a Fine of $500. There was not any reason for a departure from that figure.

Penalty:

Mr Kareem was fined $500.
