Evidence:

Following the running of Race 3 (Sir Slick The Peoples Champion 1600), Information A14427 was filed with the Judicial Committee. It was alleged that Ms Fawcett used her whip excessively prior to the 100m.

Ms Fawcett said that she understood the Rule, charge and confirmed that she admitted the breach.

Mr Jones showed the film replays and said that Ms Fawcett had hit her horse 8 times prior to the 100m.

Ms Fawcett agreed that it was 8 times (5 is the limit).

Decision:

As the charge was admitted it was found proved by the Committee.

Submission For Penalty:

Ms Selvakumaran on behalf of the Stewards said that Ms Fawcett had a clear record over the last 6 months.

Ms Fawcett said that the long straight, together with the heavy track, led to her making an error of judgement.

Reasons For Penalty:

The JCA Penalty Guide starting point for a first breach in 6 months is a fine of $300.
As there was not any aggravating feature to consider, the starting point was deemed to be a suitable penalty.

Penalty:

Ms Fawcett was fined $300.
