Excessive Use of the Whip
Evidence:

Following Race 5, Mr Goodwin lodged an Information with the Judicial Committee alleging a breach of Rule 638(3)(b)(ii) in that Mr Montes de Oca used his whip excessively prior to the 100 metres on CASTLE ON THE HILL.

At the outset of the hearing, Mr Montes de Oca confirmed he admitted the breach.

The video showed the Respondent on the outside of the field as they turned for home. Mr Goodwin counted him strike his horse with the whip 8 times prior to the 100m. The limit is 5.

Decision:

Mr Montes de Oca admitted the breach, therefore the charge was deemed proved.

Submission For Penalty:

Mr Goodwin said this was his 3rd breach of the Whip Rule in the last 6 months. In March, Mr Montes de Oca was fined $300 and in May $500. Today, following Race 2, he was warned for his whip use.

Mr Montes de Oca explained that he was on the favourite today and it wasn’t going that well. In Argentina, where he is from, there is no restriction on whip use. He said he is improving and not using the whip as much as he used to.

Reasons For Penalty:

Mr Montes de Oca has a poor record in regard to the Whip Rule. There is however a 6-month reset period, with this his 3rd charge in the last 6 months. The penalty guidelines provide for either a suspension (2 days) and fine ($2000), or a 5-day suspension.

Mr Montes de Oca is an Apprentice, and the Committee is of the opinion that a suspension is a more appropriate, and effective deterrent for an Apprentice Rider.

Penalty:

Accordingly Mr Montes de Oca is suspended from the conclusion of racing today up to and including racing on Thursday July 8th – 5 days.

Saturday June 26th and Sunday June 27th racedays were not included in the suspension due to Riders already being declared.
