Excessive use of the whip

Mr Renault, Stipendiary Steward, alleged that Mr May when driving BURNING RUBBER in race 11, the Pick & Shovel Wine Mobile Pace, used his whip on more occasions inside the final 400 metres than is permitted by cl (b) of the Use of the Whip Regulations.

Clause (f) of the Use of the Whip Regulations provides: “The whip must not be used excessively prior to the final 400 metres.”

Mr Renault demonstrated on the videos that the respondent was in the trail as the field entered the home straight and used his whip 12 times in the last 400 metres when he was taking a run in the passing lane.

Mr May agreed that the count was correct and said he had not realised he had exceeded the permitted number of 10.


As Mr May has admitted the breach, it is found to be proved.

Submission For Penalty:

Mr Renault produced the respondent’s record. Mr May had 624 drives last season, and has had 80 this season. The starting point for a second and subsequent breach is 3 days and Mr Renault submitted a penalty at that level was appropriate.

Mr May submitted this was a severe penalty when regard was had to the large number of drives he would have over 3 meetings.

Reasons For Penalty:

The count for Mr May is 12. Up until the meeting today he had a clear record under this rule, however this is his second breach in the space of 4 races. The Penalty Guide provides a starting point of 3 days for a second and subsequent breach. There are no aggravating or mitigating factors that require an adjustment to this starting point.


Mr May is suspended from driving from the end of the meeting today up to and including 30 September. This is 3 South Island meetings.
