Evidence:

Mr R Holmes was charged with a breach of 869 (2) (a), excessive use of the whip, following his drive on SIERRA GOLD in race 1 the Waitaki Woodturners Guild Trot. Stewards alleged Mr Holmes “used his whip outside clause (b) of the Use of the Whip Regulations.”

Rule 869 (2) reads: No horseman shall during any race:

(a)    use his whip in an unnecessary, excessive or improper manner.

The Whip Guidelines read:

(b)    No horseman is permitted to use their whip in a striking motion on more than 10 occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.

Mr Holmes admitted the breach. He did not attend the hearing but left verbal submissions with the stewards.

Mr Renault stated that Mr Holmes struck his horse 11 times inside the final 400m. Mr Holmes had seen the film and admitted the charge and did not wish to appear.

Decision:

Mr Holmes admitted the breach and it is found proved.

Submission For Penalty:

Mr Renault stated Mr Holmes had a previous breach of this rule in January this year, but well outside the six month reset period. He treated this as a first offence and recommended the standard fine as per the JCA Penalty Guideline at $200. 

Reasons For Penalty:

We find the breach at the low end of the scale and take into account Mr Holmes’ good record.

Penalty:

Mr Holmes is fined $200.
