Evidence:

Following the running of Race 2, Information A14560 was filed with the Judicial Committee. It was alleged by the Informant that Ms Farr used her whip excessively on her mount CAPELLANI prior to the 100m.

Ms Farr said that she understood the Rule, Charge and confirmed that she admitted the breach.

Mr Oatham showed the film replays which showed very clearly that Ms Farr had struck her mount 8 times with the drawn whip prior to the 100m (5 is the limit).

Ms Farr agreed that she had struck her mount 8 times. She added that her mount does not try very hard and on this occasion it went up and stopped, then went again and that was why she kept going.

Decision:

As Ms Farr admitted the breach the Committee found the charge proved.

Submission For Penalty:

Ms Algar said that on 22 May 2021 Ms Farr was fined $300 for consecutive strikes with the whip. She added that Ms Farr was warned for her whip use following Race 1 on today’s card.

Ms Farr said that she did not realise that she could not hit her mounts on consecutive strides, hence the fine on 22 May 2021 and added that she just tries too hard.

Reasons For Penalty:

The Committee took into account all matters relative to the breach, including the JCA Penalty Starting Point. It was determined by the Committee that a fine of $450 was a suitable penalty.

Penalty:

Ms Farr was fined $450.

In fixing penalty the Committee was mindful that jumping/highweight riders have limited opportunities compared to flat riders.
