Following the running of Race 5, the Bob Black Shivaree Memorial 1400, Mr Jones, Stipendiary Steward presented an Information charging Ms J Fawcett with a breach of Rule 638(1)(d) in that she rode carelessley.

The Rule is well known to all Riders and Ms Fawcett did not require it be read.  She admitted the breach of the Rule.

The allegation, confirmed by the race films, was that Ms Fawcett, the Rider of WEOWNATIGER allowed her mount to shift in near the 800 metres point when insufficiently clear of LOVE ME TENDER which had to be checked.

Ms Fawcett claimed, correctly, that LOVE ME TENDER was racing ungenerously and contributed to the incident.  The race films clearly illustrated the movement in by WEOWNATIGER, following the leading horse across, when not sufficiently clear, which hampered LOVE ME TENDER.

Decision:

As the breach was admitted, it was deemed proved.

Submission For Penalty:

Mr Jones' opinion was that this was a "Low Range" offence and that Ms Fawcett has had 5 previous breaches of the Careless Riding Rule in the past 12 months - although none since January 2021.  Ms Fawcett has committed riding engagements for meetings on 3, 5 and 7 April 2021.

Reasons For Penalty:

We accept the current "Low Range" starting point of 4 days suspension.  The Rider's record for the past year is aggravating, for which a further 2 days' suspension is required.  But the Comnmttee allows, as a relevant factor, that LOVE ME TENDER's ungenerous racing contributed to it's check.  The suspension period is therefore fixed at 5 days.

The Committee, in the exercise of its discretion does not impose a fine.  Ms Fawcett will miss at least 12 rides over those 5 days, losing income.

The period of suspension is deferred for 7 days, so as to commence after racing on  7 April 2021.

Penalty:

Ms Fawcett's Rider's Licence is suspended for 5 national riding days, commencing at the conclusion of racing on 7 April 2021 and ending at the conclusion of racing on 14 April 2021.
