Evidence:

Following the running of Race 7 (Jimmy Neal Electrical Hdcp 1400), Information No. A12927 was filed with the Judicial Committee. It was alleged that Mr Simpson used his whip excessively prior to the 100m.

Mr Simpson said that he was aware of the Rule and acknowledged that he admitted the breach.

Ms Algar showed the film replays and said that the Stewards agreed that Mr Simpson had struck his mount 9 times prior to the 100m (5 is the limit).

Mr Simpson agreed with the Stipendiary Steward’s interpretation of his whip use.

Decision:

Due to the charge being admitted it was found to be proved

Submission For Penalty:

Mr Jones said that it was Mr Simpson’s first day back riding for some time, accordingly his record was clean.

Mr Simpson said that he got a little carried away but that he would learn from today’s experience.

Reasons For Penalty:

The JCA Penalty Guide starting point for a first breach of the Rule is a fine of $300.

The Guideline allows for 5 strikes only prior to the 100m. Mr Simpson’s 9 strikes were clearly well in excess of what is considered acceptable, albeit it was Mr Simpson’s first day back riding for some time.

There were no mitigating feature(s) to take into account.

Penalty:

Mr Simpson was fined $300.
