Excessive Use of the Whip

Following the running of Race 7 (Lincoln Farms Whyte Handicap) Information A12329 was filed with the Judicial Committee. It alleged a breach of Rule 638(3)(b)(ii) in that the Respondent “used the whip excessively when riding CHARLIE HORSE.”

Miss Hemi confirmed that she understood the Rule and that she admitted the breach.

Using the relevant films Mr Goodwin identified Miss Hemi (CHARLIE HORSE) positioned outside the leader as the field turned for home. The RIU had estimated that she had struck her horse on approximately seven occasions prior to the 100 metres. Whilst it could have been slightly higher than that amount, the RIU submitted that they would give Miss Hemi the benefit of the doubt in relation to the count.

Miss Hemi informed the Committee that she understood the Rule and that she understood she had also committed the breach. In explanation for her actions she described that with a heavy track the difficulty was trying to get the momentum with her horse. She accepted that she had struck the horse on seven occasions. 


As the charge was admitted, the Committee deem the charge proved.

Submission For Penalty:

Mr Goodwin identified that Miss Hemi had a clear record under this Rule, however that an aggravating feature of the offending was that she had won the race.

Miss Hemi had no submissions as to penalty.

Reasons For Penalty:

The Committee considered all of the submissions placed before it. It is clear from the head-on film that Miss Hemi struck her horse on at least seven occasions. While the nature of the track was used as an explanation, it is not an acceptable excuse as all riders are expected to comply with the requirement prior to the final 100 metres. As this is Miss Hemi’s first breach within a 12 months period, a penalty in line with the JCA Penalty Guidelines is appropriate. 


Miss Hemi is fined $300.
