Contravention of the Use of Whip RegulationsEvidence:
Following the running of Race 4, (Andre Poutama Racing Stables Mobile Pace), Information A10290 was filed with the Judicial Committee. It was alleged that Mr P Ferguson the Driver of CHASE THE HAT TRICK used his whip in more than a wrist-only flicking motion in the home straight.
Mr Ferguson signed the Information that he admitted the breach and was given approval by the Chair to be absent from the hearing, as he was required to transport animals to Cambridge.
Mr Mulcay showed the available films that showed Mr Ferguson using the whip early in the run home with more than a flicking motion.
Decision:
As the charge was admitted together with the film evidence it was deemed proved.
Submission For Penalty:
Mr Mulcay said that it was Mr Ferguson’s first whip charge and suggested that a fine be imposed.
Reasons For Penalty:
As this was a first breach and taking into account the JCA Penalty Guide, a fine of $200 was considered to be the appropriate penalty.
Penalty:
Mr Ferguson was fined $200.
