CHARGES:

An information was filed by Mr C. George alleging a breach of Rule 638 (1) (d) in that J. Riddell permitted his mount Vamoose to shift inwards passing the winning post on the first occasion when not the required distance clear of Yangming (J. McDonald) which was checked and which in turn shifted in onto Karen’s Keeper which was crowded.

 

FACTS:

Mr George read Rule 638 (1) (d) and Mr Riddell confirmed that he understood the rule and the procedure to be followed.

 

Mr Goodwin showed the films of the incident where on leaving the straight Mr Riddell could be seen trying to move his mount in closer to the running rail. As he angled inwards he was only 1 length clear of Mr McDonald who ended up causing tightening to Ms Thornton’s mount.

 

Mr Riddell said that while the incident did look “a bit messy” it was made to look worse because Mr McDonald’s mount was over racing and Mr Hannam had moved outwards slightly in front and slowed up a little. He said that he was somewhat a victim of circumstances.

 

SUBMISSIONS ON PENALTY:

Mr George in making submissions on penalty said that Mr Riddell was a national rider with a good record. Recent suspensions for careless riding were in March at Woodville and one in January.  He accepted that there were some contributing factors as outlined by Mr Riddell and said that the breach was towards the lower end of the scale. Mr George added that if Mr Riddell had kept his mount straight for a couple more strides then he would not have caused any interference to other runners.

 

Mr Riddell had nothing further to add but did inform the committee that he had riding commitments up to and including Saturday September 4th.

 

REASONS:

In coming to a decision on penalty the committee considered all of the evidence and submissions presented.  We took into account Mr Riddell’s admission of the breach, his good riding record and the mitigating circumstances.  The incident happened at an early stage of the race, on a bend, when all riders were trying to steady their horses and were vying for positions closer to the rail. The films confirmed Mr Riddell’s assertion that Mr McDonald’s mount was racing erratically prior to him moving inwards which made the situation worse.

Mr Riddell made an error of judgement in moving inwards slightly too soon. The committee considered the carelessness to be at the lower end of the scale and that a suspension of 4 days was an appropriate penalty.

 

PENALTY:

Taking into account Mr Riddell’s riding commitments he is suspended from riding from the close of racing on Saturday September 4th 2010 until the close of racing on Saturday September 11th 2010.

 

 " TO ACCOUNT FOR THE CHANGE IN SCHEDULING OF THE PAEROA RACE MEETING THE DATES OF THE FOUR DAY SUSPENSION INCURRED BY MR RIDDELL ON SATURDAY 28 AUGUST 2010 HAVE BEEN MODIFIED. 

MR RIDDELL'S SUSPENSION WILL NOW END AFTER RACING ON FRIDAY 10 SEPTEMBER.  HE WILL THEREFORE BE AVAILABLE TO RIDE ON SATURDAY 11 SEPTEMBER."
