Evidence:

Following the running of the SADDLERY WAREHOUSE MOBILE PACE, an Information was lodged by Senior Stipendiary Steward, Mr JM Muirhead against Open Horseman, Mr K Marshall alleging that Mr Marshall when driving EASTANBULL used his whip on more occasions than permitted in clause (b) of the Whip Regulations.

Rule 869(2) provides : No horseman shall during any race use their whip in a manner in contravention of the Use of Whip Regulations made by the Board.

Clause (b) of the Use of Whip Regulations provides : No horseman is permitted to use their whip in a striking motion on more than 10 occasions inside the final 400 metres. This is inclusive of " backhanders" and the use applies to the horse , harness and/or sulky. 

Mr Marshall advised the Committee (by endorsing the Information ) that he did not want to be present at the Hearing and that he admitted the breach.

Stipendiary Steward, Mr S Wallis demonstrated the incident by use of the race films and showed where Mr Marshall struck his horse 14 times in the last 400 metres. He said that Mr Marshall thought that it was 13 times and Mr Wallis accepted that.

Decision:

The breach is admitted and therefore the charge is proved.

Submission For Penalty:

Mr Muirhead said that Mr Marshall had a clear record under this Rule. He said that in terms of the prescribed penalties under the Use of Whip Regulations the Committee should impose a fine of $200 on Mr Marshall.

Reasons For Penalty:

The Committee accepts the penalty submissions.

This Committee imposes a fine of $200 on Mr Marshall.
