Waikato BOP H 20 September 2020 - R 4 (instigating a protest) - Chair, Mr N McCutcheon

Created on 20 October 2020

Committee:
NMcCutcheon (chair)
Respondent(s):
Mr P Ferguson - Driver of GRIFFINS HALL
Informant:
Mr S Mulcay - Senior Stipendiary Steward
Information Number:
A12247
Horse Name:
GRIFFINS HALL
Persons present:
Evidence:

Following the running of Race 4 (White Start Stables Mobile Trot) Information No. A12247 was filed with the Judicial Committee. It was alleged that GRIFFINS HALL broke in excess of 50m in the final 200m.

Mr Ferguson representing the connections of GRIFFINS HALL said that he understood the Rules and confirmed that he contested the Protest.

The Judge’s Placings were:

1st  THE LAST GAMBLE
2nd SPLITTING IMAGE
3rd  PEANNIE
4th  GRIFFINS HALL
5th  LITTLEBITOFLOVE

Submissions For Decision:

Mr Mulcay showed the film replays and pointed out the 50m markers and said that GRIFFINS HALL had broke its gait prior to those markers and continued to gallop to the line. Mr Mulcay said that the horse should be disqualified.

Mr Ferguson said that the side-on film showed that his horse’s nose was on the 50m line when it broke. He said as there was not a direct side-on film and as it was not 100% clear, GRIFFINS HALL should be given the benefit of the doubt.

Reasons For Decision:

After viewing the film replays a number of times the Chair was comfortably satisfied that GRIFFINS HALL had galloped in excess of 50m. As a consequence the horse was in breach of the Galloping Regulations with disqualification being justified.

Decision:

GRIFFINS HALL was disqualified with the placings amended as follows:

1st  THE LAST GAMBLE
2nd SPLITTING IMAGE
3rd  PEANNIE
4th  LITTLEBITOFLOVE
5th  KEYSTONE CAVALIER
