Following race 6 an information was filed pursuant to Rule 638(1) (d). The informant Mr Coles alleged that passing the 50 metre mark Ms A Collett riding RIOAVIADOR allowed her mount to shift out under pressure when not sufficiently clear of RUBY LIPS (C Lammas) which was checked.

Evidence:

Mr Robinson demonstrated the incident using the head on and side on films. He pointed out to the committee that Ms A Collett, when racing in a 4 wide position, continued to ride forward when her mount was shifting out into the line of RUBY LIPS who was checked. He believed Ms A Collett should have done more to straighten her mount, however, conceded the level of carelessness was at the low end.
Ms A Collett had no questions of Mr Robinson’s interpretation of the video films. She agreed with his assessment of the incident and stated her mount had over reacted, with both horse and rider losing concentration.

Decision:

As Ms A Collett admitted the breach we find the charge proved.

Submission For Penalty:

Mr Coles produced Ms A Collett’s record which showed 4 previous suspensions in the last 12 months. He submitted the degree of carelessness was low range and said Ms Collett had a fair riding record. He submitted Ms A Collett is a national rider. He said along with Ms A Collett’s early admission of the breach a suspension at the low end would be appropriate.
Mr R Collett informed the committee that Ms A Collett had no firm commitments in the next 7 days and would prefer the suspension to start immediately.
Ms A Collett when questioned admitted to the committee that she was not intending to travel to the Gore race meeting on the 26th of January 2012.

Reasons For Penalty:

The committee carefully considered all the evidence and submissions as presented. The mitigating factor is Ms A. Collett’s admission of the breach. However this has to be balanced against the level of carelessness which we assess as low range, her record which can only be described as a fair record. We note that Ms A. Collett was not intending to ride at Gore on the 26th of January 2012, so therefore this date is not included in her suspension.

Penalty:

Accordingly we impose a suspension on Ms A. Collett which will commence after racing on 21st January 2012 and conclude after racing on 28th January 2012 (4 days).
