Created on 03 January 2019

Rules:
869(2)
Committee:
GHall (chair)
MConway
Name(s):
Mr P Devery - Amateur Driver
Informant
Mr V Munro - Stipendiary Steward
Information Number
A12465
Plea:
Admitted
Charge:
Contravention of the Use of Whip Regulations
Evidence:

Mr Munro, Stipendiary Steward, alleged that Mr Devery exceeded the permitted number of strikes when driving DOUBLE RAINBOW inside the final 400 metres of race 1 the BISHOPDALE TAVERN / BUSH INN TAB / ALEXANDRA NEW WORLD MOBILE PACE.

Mr Munro demonstrated on the videos that the respondent used his whip 13 times in the last 400 metres.

Mr Devery has signed the information stating he admits the breach and does not wish to be present.

Decision:

As Mr Devery has admitted the breach, it is found to be proved.

Submission For Penalty:

Mr Munro tells us that Mr Devery has accepted that 13 is the number of strikes. The penalty is determined by a sliding scale. Where the number of strikes is between 11 and 13, and it is a first offence, it is $200.

Reasons For Penalty:

We agree that the count for Mr Devery is 13. This is Mr Devery’s first breach of this rule. It is his first drive as an amateur driver. It is thus an inauspicious start to his amateur career.

Penalty:

Mr Devery is fined the sum of $200.
