Following the running of Race 6, the McGregor Grant Steeplechase, Mr A Cole presented an Information alleging that Mr H McNeill, the Rider of the winner EION “breached Rule 638(2) in that he made a celebratory gesture prior to the winning post".
Mr McNeill admitted the breach of the Rule.
The Race film showed that approximately 4 strides prior to the winning post, when his mount was comfortably in the lead, Mr McNeill stood high in his irons and raised and waved his arm in an extravagant celebration of what was to be the win of EION. “Celebratory” is akin to “triumphant” and the actions of Mr McNeill (he had already won the premier hurdle race earlier) were unprofessional and apparent to all spectators, on and off course.
Decision:
As the breach was admitted the Committee found the charge proved.
Submission For Penalty:
Mr Coles advised that Mr McNeill had enjoyed considerable success as a Jumps Jockey and had not been subject to any breaches of the Rules but noted that this was a Prestige jumping race. He contended that a fine of $200 was an appropriate penalty
Mr McNeill accepted that this approach was benevolent.
Reasons For Penalty:
The Committee saw no reason to deviate from the submitted fine.
Penalty:
Accordingly, Mr McNeill is fined $200.
