Following the running of race 5, John Deere Agrowquip 1600, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that Mrs Allpress permitted her mount to shift out near the 50 metres when insufficiently clear of MY DAKOTA which was checked.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mrs Allpress said she understood the Rule and confirmed that she admitted the breach.

Mr Coles demonstrated the incident using the available video footage. He said that near the 50 metre mark Mrs Allpress angled GAZZARA out whilst riding her mount forward. He said in doing so she made contact with MY DAKOTA who suffered a reasonable check and lost ground.

Mrs Allpress said that she strongly disagreed that she angled her mount out. She said the outward shift was the result of GAZZARA drifting out under pressure. She said the interference was an error of judgement on her part. She stated it was not a question of her trying to gain a better position as her mount had no chance of winning as GAZZARA had come to the end of its run.

Decision:

As Mrs Allpress admitted the breach the Committee found the charge proved.

Submission For Penalty:

Mr Oatham produced Mrs Allpress’ record which showed 2 previous breaches under this Rule in the last 12 months. He said Mrs Allpress was a busy rider who had a good record. He described the level of carelessness as low range and submitted a 5 national day suspension would be appropriate under the circumstances.

Mrs Allpress advised that she had firm engagements up to and including 10 November and sought a deferment to fulfil those engagements.

Reasons For Penalty:

The Committee carefully considered all the evidence and submissions presented.

Upon reviewing the video footage the Committee found that Mrs Allpress permitted her mount to shift out when placed under pressure near the 50 metres. As a result MY DAKOTA had its rightful running line taken and as a consequence was checked. The Committee accepts Mrs Allpress’ submission that her mount drifted out into MY DAKOTA and deemed the level of carelessness displayed by Mrs Allpress as low range.

The JCA Penalty Guide starting point for low range carelessness is 6 days which was adopted.

There were no aggravating factors to warrant an uplift in penalty.

The mitigating factors were Mrs Allpress’ admission of the breach and her good record. For these collective factors she was afforded a 1 day reduction in penalty.

After taking into account all the above factors the Committee considered that an appropriate suspension was 5 national riding days.

Penalty:

The Committee grants a deferment to Mrs Allpress’ suspension pursuant to Rule 1106(2).

Accordingly, Mrs Allpress had her license to ride in races suspended for a period to commence after racing on 10 November and conclude after racing on 16 November 2018.
