Decision of Appeals Tribunal as to costs given in writing this 14th day of March 2017.

1. Introduction

1.1 In our decision dated 21 February 2017 we reserved the question of costs and invited both Counsel to make submissions.

1.2 By letter dated 27 February 2017 Mr Dale advised us that Counsel had agreed on issues as to costs and no further orders were required.

2. Decision

2.1 Given the parties have agreed on the matter there will be no order as to costs between themselves.

2.2 As the appeal was able to be heard on the papers without the need for a formal hearing there will also be no order as to costs in favour of the JCA.

2.3 For the purposes of completeness we record the decision as to costs referred to in paragraph 5.4 of the Non Raceday inquiry stands.
